AUSTRALIA: Following the decision on January 10 by the Federal Court in Melbourne to reject the trade union case against BHP Iron Ore for offering individual contracts to its Pilbara workforce, the Court has, however, ordered a stay of the injunction, which will prohibit BHP from offering individual contracts pending the unions' appeal of this decision.
The case, brought by the five unions which cover Pilbara iron ore workers in Western Australia, charges that in November 1999 BHP's offer of individual contracts had unlawfully discriminated against union members and was an attempt to lure workers away from their union.
The injunction will most likely stay in place until February 19, when it is expected the Court will hear the unions' appeal.
