ICEM’s trade union affiliate in Peru, the National Miners’ and Metalworkers’ Union (FNTMMSP), has affiliated branch unions undergoing pivotal labour disputes in the South American country in the face of high commodity prices and ever-rising profit margins. 
 
On 31 August, 1,124 miners employed by China’s Shougang Hierro Perú began an indefinite strike at the country’s only iron ore mine in southern Peru. And last week, 1,100 union branch members of FNTMMSP undertook a 48-hour strike at the Sociedad Minera Cerro Verde open pit copper and molybdenum mine in Arequipa department over regressive conventions proposals in a proposed five-year labour agreement. 
 
The FNTMMSP branch and managers of Cerro Verde will meet today in efforts to resolve the dispute. If no solution is found, unionized miners will begin an indefinite strike beginning on 14 September. Cerro Verde is Peru’s third largest copper mine and is owned by US-based Freeport-McMoRan (53.7%), SMM Cerro Verde Nederlands (21%), a unit of the Japanese Sumitomo Corp., and Peru-based Compania de Minas Buenaventura (19.3%).

Cerro Verde management is proposing an initial 2% salary increase, but then seeks to eliminate all future yearly wage reviews in favour of a production bonus defined by the company and based on copper production, the mine’s financial results, and copper prices on the London Metal Exchange. 
 
In 2010, Cerro Verde produced 312,336 tonnes of copper in 2010. Notwithstanding an indefinite strike that could begin on Wednesday, 2011 production is expected to exceed the 2010 numbers slightly. The 48-hour strike on 7-8 September saw 100% participation. 
 
At Shougang Hierro’s Marcona iron ore pits in the Ica department, the strike by miners in yet another in yearly walkouts against the Chinese steel company over pay that is far lower than any other mining enterprise in Peru. 
 
Iron ore miners earn a miserly €11.18 per day (US$16.10) and are seeking a 25% increase. Shougang Hierro is offering only a US$.47 per day increase. The strike is also over a failure on the part of management to meet a list of 2011-2012 demands on working conditions, which the union submitted in April 2011. 
 
“We know that the Chinese company can meet the wage demands of workers at Marcona because of the high price of iron ore and Shougang’s large profit margins,” said FNTMMSP President Luis Castillo Carlos. 
 
The Chinese company realized a five-fold increase in profit from Marcona in the first half of 2011 from that of the same period in 2010. The first-half 2011 net profit of US$274 million came on higher sales volume and higher iron ore pricing, the company reported to Peru’s securities regulator. 
 
Iron ore sales from Marcona totaled 5 million tonnes from January through June this year, up 25% from the 4.02 million tones of refined iron ore sold during the same period of 2010. Because of the strike, Shougang Hierro declared force majeure on 1 September. A provincial government agency is involved in mediation efforts to reconcile the two sides.

Major Copper, Iron Ore Strikes Break Out in Peru

The 10th Quadrennial Delegates’ Conference of ICEM affiliate Ghana Mine Workers’ Union (GMWU) was held in late August in the Brong Ahafo regional capital of Sunyani in late August. GMWU leaders from the West African nation covered a wide range of issues including skills training, mining and sustainability, expatriation, and state investment and regulation in mining. 
 
The Delegates’ Conference also reiterated its support and continued campaign efforts for ratification and implementation by the government of Ghana of ILO Convention 176, the Safety and Health in Mines Convention. 
 
Meeting under the banner “Blending the Interest of Stakeholders in the Mining Industry Towards Operational Excellence,” delegates elected Kwarko Mensah Gyakari as National Chairman and Prince William Ankrah, ICEM’s Sub-Sahara Africa Regional Vice President, as General Secretary.

Also elected were Abdul Moomin Gbana, First Vice Chairman; Philomena Aba Sampson, Second Vice Chairperson; Eric Kwabena Gyimah, Deputy General Secretary; Fred Aniagyei, First National Trustee; James Ackah, Second National Trustee; and William Bart Plange, National Chaplain. 
 
GMWU also elected an 11-member Finance Committee. All office bearers, including Finance Committee members, were sworn in Ghana Trades Union Congress General Secretary Kofi Asamoah. 
 
The GMWU expressed displeasure with the recent shedding by the government of its 10% stake in certain gold mining companies. With gold extraction a major component in the nation’s economy, the union pledged to combine with civil society groups to reduce foreign capital in favour of Ghana private of public investment in the major mining conglomerates. 
 
The union sided with Finance Minister Kwabena Duffuor who has protested Ghana’s divestiture of 10% stakes in Newmont Gold’s Ahafo and Akyem projects, Noble Mineral’s Bibiano project, and AngloGold Ashanti development at Obuasi, Iduaprim, and Teberebie. Removal of such state involvement runs contrary to the Mining law of 1986 (PNDC Law 153) and the Minerals and Mining Act 20. 
 
GMWU also made it clear to reporters covering the Conference that with the current high price of gold, now is the time to introduce a windfall tax on the commodity. 
 
General Secretary Prince Ankrah did commend the government for putting in place the Ghana Extractive Industry Transparency Initiative (GEITI), but urged the government to adequately fund the body in order to carry out its mission. 
 
A major topic at the Delegates’ Conference regarded remuneration in mining, and the fact that inequality exists between what is paid expatriates and Ghanaian nationals who are in the same job grades and possess the same skills. 
 
On sustainability, GMWU again expressed displeasure that the major mining houses have allowed a gulf to exist between indigenous communities and their leaders. Ankrah said mining companies in general had failed to honour past commitments regarding infrastructure, and many are non-compliant with environmental standards. 
 
He also criticized mining companies for failing to take into account the input of workers regarding health and safety. 
 
The Delegates’ Conference pledged that the GMWU would continue to engage with the Ghana Chamber of Mines and its industry captains to ensure that qualified Ghanaians are given opportunities and skills development to take up senior positions in the mining sector.

Ghana Mine Workers Conducts Successful Delegates’ Conference

On 31 August, Finnish paper company UPM announced closure of two mills, the shutdown of a paper machine at another mill, the intended sale of a French mill, and the sacking of nearly 1,300 workers in total. The announcement came within months of the world’s third largest integrated pulp and paper company buying Myllykoski, another major European paper producer based in Finland. 
 
The decision does not sit well with the blue-collar and white-collar trade unions representing workers in Finland’s paper sector, Paperiliitto and Ammattiliitto Pro. Specifically, did UPM engage in the proper and correct dialogue with European Works Council (EWC) members in accord with an EWC directive on social dialogue?

UPM said the plant closures, machine shutdown, and job losses would occur by the end of the year, leaving little time for workers and their union representatives to obtain re-training funds, seek other job opportunities, and negotiate adequate redundancy packages for the soon-to-be displaced workers. 
 
Strike action is also a possibility. But at a Paperiliitto executive board meeting on 6 September, union leaders put that option on the back burner in order to engage the company – and Finland’s government – in obtaining the very highest re-training and redundancy packages. The union began that process on the local level at one mill – the Myllykoski mill in Kouvala County in eastern Finland – late last week. 
 
Ammattiliitto Pro has begun connecting with victimized workers and their unions and EWC representatives on the European level to apply pressure on UPM.

Myllykoski mill
At the Myllykoski mill, an operation with three paper machines producing magazine or lightweight coated papers, the planned redundancies amount to 371 full-time blue-collar jobs, 71 fixed-term jobs, and 101 full-time white-collar jobs. In addition, maintenance contractor ABB will see 106 permanent workers leave the rural mill. Also, other Finnish jobs staffed mainly by Ammattiliitto Pro members will be eliminated at UPM workplaces in Lahti and Pietarsarri, bringing the total job loss in Finland to 650. 
 
UPM will also shutter the Albbruck mill in Germany that produces uncoated magazine papers, costing 557 jobs. It will shut one of three paper machines that make uncoated paper and newsprint at Germany’s Ettringen mill, as well as temporarily shutting one paper machine producing uncoated fine papers at the Nordland mill. 
 
In France, the company will seek a buyer for its Stracel mill that makes coated magazine papers and specialty newsprint. In total, UPM intends to take 1.3 million tonnes annually of paper out of the marketplace and it is now clear that the company’s spring 2011 purchase of the Myllykoski company was all about capacity reductions and job curtailments. 
 
The ICEM will assist the two Finnish unions, as well as German and French unions representing workers at UPM, in all ways possible. A major tenet to ICEM’s Pulp and Paper Sector work plan, adopted at the Uruguay conference in 2008, is to extend full practical support to paperworkers of the global North who are victimized by the rampant shutdowns or paper operations in developed nations. The priority will now be to exert as much pressure as possible on UPM in order that job losses the company has created through consolidation do not escape correct and ethical social treatment.

Finnish Paperworkers’ Unions Critical of UPM’s European Mill Closures

Globalisation is not just about how things are made, bought and sold. It's also about people and their rights. Precarious work is rapidly becoming the biggest obstacle to the respect of workers’ rights worldwide. Every day, more and more workers find themselves in precarious jobs where they have no right even to join a union, let alone to bargain collectively with their employer. 
 
On 7 October unions across the globe will participate in the World Day for Decent Work (WDDW) and will raise their voices to stop the devastating spread of precarious work, which has been identified as one of the primary focuses for action in 2011 by the International Trade Union Confederation (ITUC).

In previous years, affiliates of IMF, ICEM, and ITGLWF have mobilised strongly around this date and are urged to contribute to global pressure against precarious work by participating in this year’s WDDW. 
 
It is the effective denial of precarious workers’ rights to join a union and bargain collectively that leaves them most vulnerable to exploitation. Some precarious workers are formally excluded from the coverage of national labour legislation, while others have rights on paper, but no rights in fact because laws are not enforced. And others are too afraid to exercise their rights because they could lose their jobs at any minute. 
 
The result is that millions of workers throughout the world and whole categories of employment are effectively being excluded from the reach of ILO Conventions 87 and 98. IMF, ICEM, and ITGLWF have been pushing for the ILO to do more both to identify exactly how precarious workers are being denied their rights to join a union and bargain collectively and to work with governments to remove those barriers. 
 
Now the Workers’ Bureau of the ILO (ACTRAV) is inviting unions from around the world to participate in an International Workers’ Symposium which will take place at the ILO headquarters in Geneva from 4-7 October 2011. The aims of the Symposium are to:

 <li>Examine economic and legal trends and developments in precarious work</li>
 <li>Discuss trade union strategies and responses</li>
 <li>Identify economic and social policies to combat precarious employment</li>
 <li>Identify innovative approaches to close regulatory gaps (through International Labour Standards).</li>

Fighting Precarious Work Globally

An oddity has struck Germany: as unemployment has reached the lowest levels in decades, the number of precarious workers in low-wage temporary jobs has risen dramatically. The increase in temporary work in 2010 jumped 32.5% over the previous year, reports Germany’s Federal Statistics Office in Wiesbaden. 
 
A full 75% of all recruitments in 2010 came in the temporary sector and temporary work accounted for 50% of all salaried recruitments, data that places a different light on Germany’s economic success story. 
 
This trend has not caught Germany’s unions by surprise, with national labour centre DGB making it a priority at its May 2010 Congress to campaign for equal pay, equal rights, and fixed probation periods on temporary workers at its May 2010 Congress. Replacing permanent employees with temp workers (“Stammbelegschaft”) is regressive and Germany’s unions look upon it as wage slashing. In the metal industry alone, wages of temporary workers average €776 per month less than permanent staff. 
 
In 2010, according the Wiesbaden Office, 7.4 million people took low-wage temporary work, or “mini-jobs”, as created by 2003 legislation with the intent that such work would lead to a full-time, permanent job. It has not as evidenced by Germany’s temporary employers’ federation predicting that double-digit jumps in temp work will occur in 2011 and beyond. 
 
Consider: in hotel and catering work, there is one temp for each German worker in which full social contributions are paid. In trade and retail, that ratio is two to one. 
 
One answer advocated by German unions is a cross-sector minimum wage through legislation, and tougher legislative measures to discourage all forms of precarious work. Equal pay for equal work has become a battle cry for Germany’s trade union movement and moving toward that will restore a fairer order of the labour market.

In Germany, Precarious Labour Spikes Even with Low Joblessness

In its decision of May 2011, the Mexican Tribunal for Freedom of Association reported grave violations by the Mexican government of workers’ freedom to organize unions, and denounced the intensifying climate of violence against union members. 
 
In August, under false premises the Mexican government ordered the detention of General Secretary Martin Esparza Flores and other leaders of the Mexican Electricians’ Union (SME). The employees of the Workers’ Support Center (CAT), an organization which supported the unionization of Johnson Controls in Puebla, Mexico, have been publicly charged with destabilizing the situation in that state. 
 
In addition, no just solution has yet been achieved to the conflict of the SNTMMSRM, which is led by Napoleon Gomez and affiliated with the IMF and the ICEM. August marked the fourth anniversary of the beginning of the strikes in Sonora, Taxco, and Sombrerete, with no response from the authorities: collective contracts are not recognized and the independence of the union is not respected. 
 
The IMF, ICEM, ITF, and UNI, together with the Tri-National Union Alliance and the ITUC, stand together with the Mexican unions in their struggle, as was shown by action of unions around the world during the action week of February 2011, as well as by international union participation in the 1 May event in Mexico. 
 
Also in May, the IMF organized a planning workshop attended by representatives of the international union federations and democratic unions of Mexico to jointly design union-building programs. With regard to international solidarity, it was agreed to concentrate work on opposing the PRI-PAN bill on the regressive Labor Reform and the bill on National Security, both of which are on the agenda for the September session of the Mexican Congress. If these reforms are passed, precarious employment will be legalized, employer protection contracts will be strengthened and it will be even more difficult to organize genuine workers’ unions. 
 
Given that prospect, and added to it the fact that the Government Secretariat intends to remove by 15 September the sit-in protest which the SME Union has been holding on the Zocalo for the last seven months, the unions have been intensifying their action and alliances to confront the new wave of repression. 
 
On 1 September, the fourth anniversary of the Felipe Calderon administration, a “National Day of Outrage” was held to denounce the disastrous results of his administration for the working class. More than 100 unions and 40,000 people participated in the day; a rally was held in front of the Chamber of Deputies, and later moved to the Zocalo. It demanded an end to the persecution of independent unions and reiterated the importance of building a sustainable and inclusive social model with fairness, justice and democracy.

Greater Unity of Democratic Unions in Mexico against Repression

Multi-stakeholder negotiations in Indonesia, bringing together major sportswear brands, key manufacturers and five unions – including ITGLWF affiliates SPN and Garteks – have cumulated in the signing of a protocol to protect trade union rights. 
 
The negotiations began in November 2009 following a major Play Fair campaign and a commitment by major sportswear brands to engage country-by-country with trade unions in order to agree concrete steps to bring about improvements to working conditions in the industry. 
 
The protocol, signed on 7 June, addresses the fact that unions in Indonesia’s garment and footwear sectors are frequently denied the time and space they need to carry out their duties. The protocol outlaws all forms of anti-union discrimination and requires that a CBA, where none exist, be negotiated within six months. The agreement provides for the release of union officials from work duties in order to carry out their union activities; requires provision of adequate office, meeting and notice board space; gives unions the freedom to distribute information without interference; and commits signatory factories to facilitate a check-off system for collecting union dues. 
 
Initial signatories comprised multinational brands adidas, Nike and Puma, their key suppliers, and five Indonesian unions including SPN and Garteks. Playfair 2012 launched an action, exactly one year before the London 2012 Olympics, to encourage additional brands to commit to the protocol. The action was well supported and since then Pentland – owners of the Speedo brand, Asics, and New Balance have agreed to sign the protocol. 
 
Although implementation is in the embryonic stages, some steps have been taken to socialise the protocol. adidas have held workshops for their 58 Indonesian suppliers to inform them about the protocol and encourage them to agree to its provisions, and Nike have promised that all of their suppliers will know about the protocol by the end of October. ITGLWF affiliate Garteks report that the protocol has opened the door for them to negotiate a CBA and they have also seen their membership increase in that factory. 
The ITGLWF is urging all garment and footwear brands sourcing from Indonesia to sign the protocol.

Multi-Stakeholder Negotiations Lead to Garment Framework Agreement

The ArcelorMittal Health and Safety Committee, created in June 2008 in a common effort by the company and unions to improve safety in ArcelorMittal, issued its first report of activities on 15 August called “Together for Safety.” The number of fatalities has declined since 2008, but remains unacceptably high in the company. 
 
In 2008, ArcelorMittal management and unions signed an agreement to create a Joint Health and Safety Committee to address the high number of fatalities in the company’s units. The Committee is composed of representatives of the IMF, the European Metalworkers’ Federation, the United Steelworkers (USW), CNM-CUT, a mining area representative, and company Health and Safety representatives. 
 
On 15 August, the Joint Global Health and Safety Committee launched its first report, concluding it has had a positive impact on the number of fatalities, which it ascribes to good workplace cooperation between trade unions and management. 
 
Since its inception, the Committee has created local health and safety committees and made site visits in priority company sites in Kazakhstan, Brazil, Mexico, Czech Republic, Romania, South Africa, USA, Argentina, and Ukraine. During these visits, local union members and management met with committee members to review the local safety situation and develop a health and safety action plan. The committee has then arranged follow-up visits. 
 
The committee concludes that it has had a positive impact on the number of accidents in the workplace, especially fatalities, and helped reduce risk faced by workers. It has also helped to improve communication and cooperation between unions and management, locally and globally. 
 
The committee, however, also notes an increase in the number of fatalities in the last year – from 36 in 2009 to 41 in 2010, which is considered to be unacceptably high by both unions and management. 
 
There remain issues of dispute between unions and management. The company has publicised a set of “Golden Rules” for safety and associated actions, including penalties for violations, while unions fear that this violations policy will impede safety by dissuading workers to report about minor accidents and near misses, thereby creating a lazy safety management culture. 
 
There is also joint criticism of inconsistent responses to requests for health and safety training, and a deficient dialogue on the subject at some business units and work sites. 
 
The parties remain committed to the committee’s work, and see the joint report and accompanying union and management statements as evidence for a working dialogue and commitment to building a positive workplace culture. 
 
The report, “Together for Safety,” has been issued in English, and will be published also in French, Spanish, German, and Portuguese.

Common Efforts Input to Workers’ Safety at ArcelorMittal

Similar to integration on the global level, European industrial union federations are integrating for greater strength and more social power. As part of that, the European Mine, Chemicals, Energy Federation (EMCEF), the European Metalworkers’ Federation (EMF), and the European Trade Union Federation – Textiles, Clothing and Leather (ETUF-TCL) issued a recent common and joint position on the Eurobonds debate aimed at the European Central Bank and the Council of the European Union. 
 
General Secretaries Michael Wolters (EMCEF), Ulrich Eckelmann (EMF) and Luc Triangle (ETUF-TCL) warned banks again could be the nemesis of the real economy and the fight over Eurobonds must be put on hold while action is focused on supplying the real economy with liquidity instead. 
 
The three federations said creation of a Eurobond market is no guarantee that banks will make necessary industrial investments with an economic environment that still allows speculation and opportunism to exist. This bodes badly for small- and medium-sized industrial enterprises, in particular, and lack of investment here could be a death knell. 
 
“The recovery of industry – and hence millions of jobs – is seriously threatened,” stated the three federations. “It is foolish and short-sighted to exclusively focus on austerity measures despite the need to discuss budget consolidations and develop a fair framework for responsible governance. 
 
Advocating the Financial Transaction Tax as a start, EMCEF, EMF, and ETUF-TCL said “sustainable investments are required to secure the stability of the real economy.” Necessary investments can be made by European Union future investment bonds which must be limited in time, related to specific projects, and financed by levies placed on the capital of wealthy speculators that caused the financial crisis in the first place.

European Trade Federations Demand Economic Liquidity for Job Creation

Codelco, the state-owned mining company of Chile and world’s largest copper producer, reached early terms with three of its five mining unions at El Teniente in Region VI ten days ago. The 40-month agreement will take effect on 1 July 2011 and will cover 2,500 of El Teniente’s 4,000 miners. 
 
The branches of Federación de Trabajadores del Cobre (FTC) that agreed to terms were Sindicato No. 5, Sindicato No. 7, and Sindicato de Trabajadores Caletones. One of the two other branches rejected the proposal, while the other was not included in bargaining. 
 
The package is expected to be considered by those mineworker trade union branches in the coming days. 
 
The collective agreement includes a 3.85% wage increase on 1 July and a CLP 12.3 million (€17,680, US$25,324) bonus, which matches the bonus paid miners at other Codelco divisions in 2010. It also includes an optional loan of CLP 3 million, and a 10% increase in the annual bonus that comes on Chile’s national day, 18 September.

El Teniente is an underground mine that includes some 2,400 kilometres of shafts. It includes an ore processing operation producing molybdenum, and its output of copper lingots and copper anodes is 404,000 tonnes per year. In 2010, it accounted for 27.2% of Codelco’s US$5.8 billion profit. 
 
At another Codelco copper operation, Chuquicamata, part of the El Norte division, FTC branches and management met 12 April to discuss staffing requirements. The Chuquicamata mine recently shed a number of jobs due to union-negotiated early retirements as the operation prepares for a conversion from an open-cast mine to an underground one. 
 
FTC Sindicato No. 1 Vice President Héctor Roco said the union, and three other FTC branches at Chuquicamata, want workers to be given the opportunity to transfer to areas where retirements have lowered job rolls, and they also want a say in the planning of the transition to underground mining. 
 
Codelco employs 17,000 miners in Chile at five divisions: El Norte, Salvador, Andina, El Teniente, and Ventaras.
