Participants of the recent Joint ICEM-IMF World Conference on Sustainability, June 18-19, Toronto, Canada, adopted unanimously a statement regarding the British Petroleum (BP) oil well blow-out in the Gulf of Mexico. 
 
The statement demands an independent and open inquiry into the causes of the Deepwater Horizon disaster, a process to which trade unions should be granted full insight. 
 
In the years prior to the 20 April oil rig explosion that caused the current disaster, BP had repeatedly made assurances that “best available technology” is in use in all its operations. It has since become clear that this was not true at the Deepwater Horizon drilling rig operation. The Statement demands that “blow out prevention (BOP) systems should have remote control capabilities, for instance acoustic signal actuators, in addition to traditional BOP controls”.

The participants at the Toronto Conference included 270 trade union leaders from the industrial and manufacturing sectors of some 50 countries, affiliated to the International Federation of Chemical, Energy, Mine, and General Workers’ Unions (ICEM), and the International Metalworkers’ Federation (IMF), and the International Textile, Garment, and Leather Workers’ Federation (ITGLWF). In total, the number of workers represented by these organisations and their affiliates exceeds 55 million people and includes the most important unions in the petroleum sector, worldwide. 
 
Local sponsors of the event in Canada included the Communications, Energy, Paperworkers Union of Canada (CEP), the Canadian Auto Workers (CAW), the Power Workers Union (PWU), the United Steelworkers (USW), and the International Association of Machinists (IAM).

ICEM, IMF, ITGLWF Affiliates Demand Better Governance of Oil Industry

The ICEM French trade union affiliate, the Federation of Chemical and Energy Workers (FCE-CFDT) Union, elected Jean-François Renucci to the post of General Secretary, with the 48 year-old succeeding Patrick Pierron, who served seven years as General Secretary. 
 
Jean-François Renucci was unanimously proposed by the union’s Federal Executive and subsequently elected by the Federal Steering Committee. Renucci began in his new role on 1 June, as the federation’s third general secretary. 
 
The FCE-CFDT has described their new General Secretary as a dedicated trade unionist, with the necessary determination and experience to lead the trade union action of the federation, during turbulent financial conditions, globalisation, and ever-changing social conditions.

Jean-François has identified social dialogue as the key in the effort to improve conditions and rights of workers, individually and collectively. According to the new general secretary, collective bargaining is the only way to ensure fair treatment of employees in small, medium, and large sized companies. Jean-François has been involved in negotiating collective agreements in all sectors and at all levels, local, national and international, and he has consistently identified mutual respect, trust and confidence as key factors to success of collective bargaining. 
 
Jean-François has made communication and participatory debate a priority for effective decision making, and the internal democracy of the federation. He hopes that in changing the general secretary, the organisation will not change its line or direction, but will give a renewed impetus to continue to implement decisions agreed collectively. 
 
The ICEM salutes and thanks outgoing Patrick Pierron, and congratulates Jean-François Renucci.

Day eight of the strike by 6,000 members of the National Union of Metalworkers of South Africa (NUMSA) against four global tyre producers begins today with negotiations continuing. NUMSA and the New Tyre Manufacturing Employers’ Industry Association (NTMEIA) have been locked in a dispute since mid-August over pay, term of agreement, labour brokers and short-term contract workers, and other conditions of work. 
 
The four tyre companies affected include Bridgestone/Firestone, Continental, Goodyear, and Apollo-Dunlop. Bridgestone/Firestone and Continental had served notices of lockout to NUMSA prior to the strike. 
 
The employers’ association is seeking a three-year agreement, while NUMSA prefers a one-year deal. The two sides remain far apart on wages. NUMSA is seeking an 11% initial year increase while bosses have offered 8.5%, with the exception of Bridgestone which is offering 7%. Employers are offering a second-and third-year increase pegged at the consumer price index (CPI) plus 1%, or 5%, whichever is higher. 
 
If it is to agree on a three-year pact, NUMSA is insistent on year two containing either a 12% increase or CPI plus 2%, whichever is greater, and a third year increase of 14% or CPI plus 3%, whichever is higher. 
 
The union seeks consultation over all short-term or temporary employment contracts, as well as abolishment of all labour brokers in the South African tyre industry. It also wants direct temporary workers to be made permanent, full-time staff at six months of service. Other contentious issues include a 70% local content requirement regarding sourcing, premium pay for work on Saturdays, Sundays, and holidays, and an adequate training pool and training to occur during work-time hours.

NUMSA and the NTMEIA have been negotiating since April 2010 on a renewal agreement to a three-year pact that expired on 30 June. 
 
On 1 September, NUMSA also launched a strike against both the Retail Industry Motor Association and the Fuel Retailers’ Association. Carrying out those strikes are 70,000 NUMSA members at garages, auto component shops, petrol stations, and various workshops and retail outlets that make auto components. 
 
Besides a 40-hour work-week, the union is seeking 15% across-the-board increases for notoriously low-paid workers in these areas, while the associations are offering only 6.6%. Already, one auto assembly plant, Volkswagen in Utinhage, has had to shut operations and send workers home due to a shortage of auto components. 
 
On 2 September, the ICEM sent affiliated NUMSA and its General Secretary, Irvin Jim (photo on site), a message of solidarity, stating, “We have learned that your 6,000 members in the tyre industry, overwhelmingly at the multinational companies namely Bridgestone, Continental, Apollo-Dunlop, and Goodyear, as well as 50,000 members in the auto-supplier industries, are now striking following the failure of collective negotiations due to your rightful demands not being accepted by employers. 
 
“On behalf of the whole ICEM family, I cordially salute the heroic strikes engaged by NUMSA and its members in both industries. I am also proud to announce our heartfelt solidarity and support to you. We have already alarmed our affiliated unions in those sectors throughout the world who are shoulder-to-shoulder with you.” 
 
The strikes in all three South African auto-related industries come just two weeks after 31,000 NUMSA auto workers struck seven car makers affiliated to the Automobile Manufacturers Employers’ Association. That strike lasted eight days, until 19 August.

South Africa Tyre Strike Continues into Week Two

Grupo Mexico reacted with violence to a 20 August worker ballot at the Esqueda smelter in Sonora State, where workers voted to end the protection contract with a company union, and re-join Los Mineros Section 207. The Calderón government again supplied the police units, who moved into the mine, aggressively intimidating workers. 
 
The police attack occurred on the morning of 31 August, when over 1,000 heavily armed federal and state units occupied the smelter and surrounding area. 
 
The company union was imposed on Esqueda’s workers three years ago through the use of firings, threats, and repression. Roheri Cruz Sanchez, leader of Section 207, reports that the company union systematically ignored workers’ concerns, signed a ‘protection’ collective agreement without consulting workers, and never even revealed the terms of the collective agreement to workers. 
 
Grupo Mexico has already begun sacking all of the workers involved in resisting the police siege.

“This blatant act of repression clearly puts Grupo Mexico’s anti-union vendetta ahead of the company’s interest in having stable labor relations,” declared Leo W. Gerard, USW international president. 
 
Following the international outcry over the violent police attack on Cananea’s striking miners in February this year, the Calderón government and Grupo Mexico’s continuation of its brutal repression of workers’ rights is extremely concerning. 
 
As continuing efforts to free the trapped miners in Northern Chile have received special attention from the country’s president Sebastian Piñera, Los Mineros renewed calls for a full governmental inquiry into the Pasta de Conchos mine disaster, 19 February 2006, which killed 65 miners. The decision to reissue the demand for justice for the 65 killed miners was taken by the National Executive Committee of the National Union of Mineworkers, known as Los Mineros, on 24 August.

Pasta de Conchos Widow
There has never been a criminal conviction over the Pasta de Conchos disaster, described by Los Mineros General Secretary Napoleón Gomez as “industrial homicide”. The parallels between the aftermath of the Chile mine collapse and that of Pasta de Conchos are striking, while national and local government came to the San Esteban Primera mine to support rescue efforts, Mexican presidents Fox and Calderón have never appeared at Pasta de Conchos, neither has Germán Larrea CEO of Grupo Mexico. 
 
The most poignant difference in rescue efforts for Los Mineros and the families of the 65 dead miners at Pasta de Conchos, is that at the Chile mine accident the trapped workers were found seventeen days after the collapse of the mine shaft, while rescue efforts were halted after five days in Mexico, when families were only a few metres away from their trapped loved ones. As Grupo Mexico and the Mexican government halted rescue efforts, and disconnected the electricity making any continuation of the search impossible, they made it impossible to carry out a proper investigation into the cause of the mine collapse, believed by many to be illegal safety conditions in the mine. 
 
Sixty-three of the 65 mineworkers killed at Pasta de Conchos are still buried in the mine. Their widows and families have never been properly compensated.

ICEM Condemns Repression of Workers by Mexican Government, Grupo Mexico

Successful bargaining between the ICEM affiliated Argentine Trade Union of Tyre Workers (SUTNA), Argentina’s Chamber of Commerce, and the Ministry of Labour culminated in agreement on 23 August, in Buenos Aires. A new collective agreement for the sector, covering the period July 2010 to June 2011, provides a salary increase of 27.5 percent, plus improved conditions and a lump sum for members. 
 
The agreement lays out a reclassification of jobs in the sector which improves social benefits by an average of 12 percent. All workers will also receive a lump sum of 1,000 pesos (US$250) and a further payment of 500 pesos in January.

Of the 27.5 percent pay rise, 22.2 percent will be retroactive to 1 July 2010, with the remaining 5.3 percent increase coming on 1 January 2011. SUTNA General Secretary Pedro Wasiejko commended the corporate commitment to negotiate in good faith, with talks to reopen in the first half of 2011, “there will be further improvements to these gains” stated Wasiejko. 
 
The collective agreement was accepted by 75.5 percent of workers balloted, with a turnout of over 80 percent. 
 
The ICEM salutes SUTNA and its General Secretary Pedro Wasiejko for achieving such significant advances for its members.

Argentina’s Rubber Workers Achieve Significant Wage Gains

A woman and metalworker won election as General Secretary of Italy’s largest labour federation, the Italian General Confederation of Labour (CGIL). Susanna Camusso was elected by the federation’s 160-member National Executive Assembly on 3 November with a 79.1% vote, succeeding Guglielmo Epifani who stepped down due to term limits. 
 
Camusso, 55, becomes the first woman to lead a major national labour centre in Italy, and the challenges in front of her are great. Considered Italy’s most militant labour federation, the 5.7-million-member CGIL must confront the €23.5 billion in public spending cuts that the Berlusconi government is proposing, and it faces social regressions that car-maker Fiat is demanding in return for investing in Italian auto factories. 
 
Following her election, she said of Silvio Berlusconi, “The more he governs, the more trouble he creates.” She said the sooner that Berlusconi retires from public office, “the better it will be for the country.”

Regarding Fiat, she must navigate the militancy of CGIL’s Metalworkers (FIOM) branch – once her own constituency – with the moderation of Italy’s other two national labour centres, the UIL and CISL, in dealing with the automaker. One test will be Fiat’s insistence on individual factory agreements instead of a national collective agreement. 
 
Another will be the determination by Fiat CEO Sergio Marchionne to drive a wedge between CGIL-FIOM and the other federations in coming talks over implementing the company’s five-year, €20 billion investment plan in Italy. 
 
Camusso began her union career in 1977 as a union organiser for CGIL’s FIOM branch in Milan. Over a 20-year career there, she built a reputation as a fierce negotiator, having bargaining numerous collective agreements in the auto and metalworking sectors. She is considered a pragmatic, results-oriented labour leader.

In 1997, she left FIOM in Milan and became a regional leader for CGIL in the Lombardy region. In 2005, she founded the Italian women’s rights movement “Let’s Get Out of Silence” movement. On her election earlier this month, she said full women’s rights must be a condition for democracy in Italy and the demeaning issue of prostitution must find a place on the national agenda, an obvious reference to Berlusconi’s style. 
 
She was elected a member of the CGIL’s 10-member national governing board in 2008, became the federation’s deputy general secretary at the May 2010 Congress, and was Epifani’s choice to succeed him earlier this month. 
 
Camusso will often be paired in her new duties with Emma Marcegaglia, the leader of the industrial employers’ federation Confindustria. The two women share a mutual respect for one another other, with Marcegaglia saying early this month she has “a very positive opinion” of Camusso.

First Woman Elected to Lead Italian National Labour Federation

ICEM Australian affiliate Construction, Forestry, Mining, and Construction Union (CFMEU) won a precedent-setting case last week before the full judicial panel of Fair Work Australia. The matter involves global mining house Xstrata’s redundancies at the Ulan coal mine near Mudgee, New South Wales, and whether or not those sackings were “genuine redundancies,” or if the employer had first to deliver alternative jobs at other company enterprises. 
 
On 12 November, the full bench of Fair Work Australia rejected an Xstrata appeal and ruled that the company had an obligation not just to make vacancies at other company enterprises known to the dismissed workers, but to offer positions and facilitate transfer to those worksites. 
 
In effect, the ruling establishes concise guidelines regarding “genuine redundancies” and ensures that employers can be held liable if they do not fully offer and then redeploy sacked workers in all reasonable circumstances.

In 2009, Xstrata Coal Pty. Ltd. made redundant over 100 workers at its 500-worker Ulan mine. The CFMEU claimed the company would replace many of those workers with contract employees. Last week’s ruling covers six of ten miners whose rights, under Australia’s new labour statute, were violated because the dismissals were not “genuine redundancies” since their jobs were still being performed. 
 
The other four were found not to have reasonable redeployment options due to light-work injury status or unwillingness to travel. 
 
Last week’s full bench ruling stated: “Where an employer decides that, rather than fill a vacancy by redeploying an employee into a suitable job in its own enterprise, it will advertise the vacancy and require the employee to compete with other applicants, it might subsequently be found that the resulting dismissal is not a case of genuine redundancy. This is because it would have been reasonable to redeploy the employee into the vacancy.”

CFMEU Wins ‘Fair Work Australia’ Case Involving Xstrata’s Illegal Dismissals

The US United Autoworkers’ Union (UAW) will divest hundreds of millions of dollars from JPMorgan Chase over the bank’s refusal to implement a two-year moratorium on housing foreclosures in the state of Michigan. The divestiture of pension, health care, and other union-managed funds from the New York-based bank is also due to Chase’s ties to the RJ Reynolds Group, and that company’s treatment of low-wage farm workers in the US state of North Carolina. 
 
At a press conference on 24 September in Detroit, UAW President Bob King was joined by church and American farm-labour leaders in calling for a full citizens’ boycott of JPMorgan Chase. King and a coalition of civil society leaders from Michigan met with bank officials in June following a protest and requested a moratorium on home foreclosures of unemployed workers.

At a follow up meeting, UAW and religious leaders called on Chase to join President Barack Obama’s Hardest Hit Homeowners programme and declare a temporary freeze on foreclosures. Although the bank made a good-faith promise to continue the dialogue with the social partners, the bank “has since failed to communicate its intentions regarding any of the issues raised,” said the UAW. 
 
At the press conference ten days ago, US Farm Labour Organising Committee President Baldemar Velasquez detailed low wages, unsanitary conditions, and the Reynolds Group’s hindrance of trade union organizing rights for tobacco workers. 
 
King said Americans “have a moral responsibility to step up” and join the boycott. “Chase needs to help unemployed homeowners in Michigan and underpaid farm workers in the Carolinas,” stated King. “The bank could make a huge difference by suspending foreclosures and pressuring RJ Reynolds to do the right thing.”

US Auto Workers’ Pull Money from Bank over Home Foreclosures

Responding to the European Commission’s recommendation that member states should consider suspending offshore licensing in advance of possible new EU-wide safety standards, Norrie McVicar, Chair of the ITF’s Offshore Task Force Group (OTFG), said: “This is the wrong position to take and the wrong time to take it. The EC should be protecting the safety gains made in the UK offshore sector, not eroding them by dumbing them down to a lowest common denominator.” 
 
Lars Myhre, ICEM Energy Sector Chair, added: “You can never be too safe and we would never condone complacency, but the British and Norwegian sectors are generally good examples of best practice. They should be studied, learned from and, where necessary, improved. They shouldn’t be remodeled into a one size fits all – but not very well – Euro model.” 
 
McVicar also stated: “One very positive feature of the UK industry is OSPRA, the Oil Spill Prevention and Response Advisory Group, which brings together regulators, industry bodies and trade unions such as Unite and the RMT in a joint effort to ensure that we get the oil and gas we need as safely and cleanly as possible. It’s that kind of good practice that we’d like to see adopted by the rest of the global oil and gas sector, not weakened here in Europe.”

ITF, ICEM Oppose EC’s Offshore Safety Recommendation

In line with the Global Framework Agreement (GFA) signed jointly by the ICEM and the International Metalworkers' Federation (IMF) with Belgian-based Umicore, a chemicals, metal technology, and catalyst systems company, the parties conducted a mission to Umicore subsidiaries in South Africa from 24-26 January. 
 
It was the third such mission since the GFA was signed in September 2007, with the two previous ones to China in 2009 and to Brazil in 2010. The main objective of the joint missions, as a regular exercise in accordance with the relevant provisions of the agreement, is to monitor compliance.

Umicore’s South African plants are located in the city of Port Elizabeth, Eastern Cape province, and are called UACSA and UCPE. They are part of the company’s automotive catalysts business segment, one of four business units of Umicore. The area is a leading producer for automobiles and auto parts. 
 
Umicore was represented by Ignace De Ruijter, Senior Vice President of Human Resources; Guy Ethier, Senior Vice President of Environment, Health and Safety; Mark Dolfyn, Director of Human Resource Development; and Kerry Bryans, Managing Director of Umicore South Africa. From the trade union side, ICEM Chemical and Rubber Industries’ Officer Kemal Özkan, Belgian trade union officer Luc Triangle of ACV-CSC METEA (representing the IMF), and the Chairman of the Umicore’s European Works Council and member of ICEM German affiliate IGBCE, Peter Kamm, attended. 
 
From South Africa, representatives from ICEM-affiliated Chemical, Energy, Paper, Printing, Wood, and Allied Workers Union (CEPPWAWU) from both Umicore plants also participated. The internal trade union meeting also welcomed Vuyo Bikitsha, Regional Secretary, and Mziyanda Twani, Educator, from the ICEM- and IMF-affiliated National Union of Metalworkers of South Africa (NUMSA), which had membership at UCPE plant in the past. 
 
Considering recent issues between local management and trade unions in the Port Elisabeth plants, the visit by the ICEM and IMF representatives resulted in positive and constructive evaluations. The plant visits also assisted workers in resolving some outstanding local issues. 
 
The mission resulted in a number of concrete results, including a conclusion that local communication on a number of issues, including recruitment procedures, structure of employment, integration of both plants, and training and education, should be further advanced and would benefit from greater engagement by both parties. By doing this, the results are in line with the objectives of the GFA to create mutually beneficial relations and dialogue between all the partners.

Trade Unionists Visit “UMICARE,” a Social Project by the Belgian Company in South Africa
The ICEM and IMF representatives were impressed by the excellent work of the local trade union representatives, and also recognized that local and corporate managers play a crucial role in creating better social dialogue within the company for the future. This visit will be evaluated in April 2011 at the next GFA Monitoring Committee with management. Both ICEM and IMF are ready for the continuation of the GFA. 
 
As part of the South African mission, the trade union delegation also visited a social project financed by the local company called “UMICARE.” The programme, while small, enables children to gain valuable opportunities in schooling to improve their chances for a better life. 
 
ICEM’s Özkan commented on the visit: “While approaching the four-year mark of the Umicore GFA, I am proud to observe very positive and concrete steps forward. Each joint mission has given us important input and synergy for future activities with positive expectations. I do believe that dialogue between ICEM/IMF and Umicore is an excellent model of global industrial relations tailored for what we need to create as a global union federation.”
